Terms of Service

1. Acceptance of Terms

By adding NotNicePool ("the Bot") to your Discord server or by using the NotNicePool web dashboard at notnicepool.xyz ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service, in accordance with Discord's own Terms of Service. If you are under the age of majority in your jurisdiction, you must have parental or guardian consent to use the Service.

3. Description of Service

NotNicePool is a Discord bot that provides moderation, leveling and XP tracking, invite tracking, tickets, starboard, giveaways, scheduled messages, reaction roles, achievements, and a web-based dashboard for server configuration and analytics. Some features may be designated as premium and require a paid subscription.

4. User Responsibilities

• You must comply with Discord's Terms of Service and Community Guidelines at all times.
• You are responsible for configuring the Bot appropriately for your server. Misconfigured moderation rules or AutoMod settings are your responsibility.
• You must not attempt to exploit, abuse, or interfere with the Bot's operation, including but not limited to: XP farming with alt accounts, spamming commands to overload the service, or attempting to access data belonging to other servers.
• You must not use the Bot to facilitate harassment, hate speech, or any illegal activity.
• Server administrators are responsible for informing their members that the Bot collects data as described in our Privacy Policy.

5. Premium Services

Certain features of the Bot may require a premium subscription. Premium subscriptions are granted on a per-guild basis and may include an expiration date. Features included in premium tiers are subject to change. We reserve the right to modify premium pricing and features with reasonable notice.

Premium access may be revoked if you violate these Terms of Service.

6. Dashboard Access

The web dashboard requires authentication via Discord OAuth2. By logging in, you authorize us to access your Discord user ID, username, avatar, and the list of servers where you have the Manage Server permission. Dashboard sessions are maintained via secure, HttpOnly cookies.

7. Data Collection & Privacy

Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to the data practices described therein.

8. Availability & Uptime

We strive to maintain high availability but do not guarantee uninterrupted service. The Bot may experience downtime due to maintenance, updates, Discord API outages, or unforeseen technical issues. We are not liable for any damages resulting from service interruptions.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the maximum extent permitted by law, Privonix Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

We are not responsible for actions taken by the Bot as a result of your configuration (e.g., moderation actions, AutoMod filters, role assignments).

10. Intellectual Property

All code, design, branding, and content associated with NotNicePool are the property of Privonix Technologies. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service at any time by removing the Bot from your server.

Upon removal of the Bot from a server, stored data for that server may be retained for a reasonable period before deletion.

12. Modifications to Terms

We may update these Terms of Service from time to time. Changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.
